Artikel 10 bagi Perlembagaan Persekutuan di Malaysia

(1)Tertakluk pada Klausa (2), (3) dan (4) -
(a) setiap warganegara mempunyai hak dalam kebebasan untuk berkata-kata dan ucapan;
(b) semua warganegara mempunyai hak untuk berhimpun dengan aman dan tanpa senjata;

(c) semua warganegara mempunyai hak untuk menubuhkan persatuan.

*Klausa (2), (3), dan (4) adalah sekatan-sekatan yang boleh dikenakan ke atas hak-hak dalam klausa (1) jika dianggap perlu untuk keselamatan negara.

Merbahaya? Ancaman kepada keselamatan negara?

Seksyen 8 dalam Akta Keselamatan Dalam Negeri 1960 membolehkan Menteri Dalam Negeri mengeluarkan perintah tahanan selama dua tahun, tanpa melalui proses perbicaraan, terhadap mana-mana individu bagi tujuan mencegahnya daripada melakukan sebarang tindakan yang boleh mengancam dan memudaratkan keselamatan negara.Nampak sangat kau ni bahlol tahap keldai, Khairul. Keldai pun lagi pandai dari kau.

Tapi kalau hendak sangat berdebat, meh sini, berdebat dengan aku kalau rasa hebat sangat. Aku takder title-title hebat macam ko, tapi setakat berdebat dengan sotong kurap picisan macam ko ni bring it on!

Polis nafi pro ISA berjaya lepas ke Istana Negara

KL: Majlis Gabungan NGO Pembela Negara (Magaran) sama sekali tidak menyerahkan memorandum mempertahankan Akta Keselamatan Dalam Negeri (ISA) kepada Istana Negara sebagaimana didakwa oleh kumpulan pro-ISA kelmarin, kata polis semalam.

Ketua Polis Daerah Brickfields, Asisten Komisioner Wan Abdul Bari Wan Abdul Khalid menjelaskan penasihat undang-undang Magaran, Mohd. Khairul Azam Abdul Aziz telah ditahan polis kira-kira 7 petang kelmarin ketika mendekati kawasan Istana Negara.

Sehubungan itu tegas beliau, tahap kawalan keselamatan di kawasan Istana Negara juga tidak pernah dicerobohi.

“Memorandum kumpulan pro-ISA tidak pernah diserahkan (kepada Istana Negara), wakil Istana Negara juga tidak hadir untuk menerima memorandum,” katanya.

Jelas Wan Abdul Bari, apabila Khairul cuba untuk melepasi sekatan jalan yang dikenakan, beliau telah dibawa ke pusat subtaktikal berhampiran dan maklumat peribadinya diambil.

Katanya lagi, Khairul telah dilepaskan kemudian kerana beliau tidak memperlihatkan sebarang ciri-ciri mengancam keselamatan.

Kelmarin kumpulan pro-ISA berkata pihaknya bangga kerana berjaya menyerahkan memorandum kepada Istana Negara melalui pintu masuk belakang.

Memang kaki putar belit, siapalah yang bodoh sangat nak percaya kat ko ni Khairul? Sudah merepek tu, bagus balik rumah peluk bini. Sekarang, 1Malaysia dah tahu bahawa Mohd. Khairul Azam Abdul Aziz ini merupakan seorang pengkhianat parti, penipu, bodoh perasan pandai, bodoh tidak bertempat, bodoh dungu, bodoh keldai, bodoh tolol dan yang sejenis dengan yang bodoh-bodoh.

Just came back from a friend’s wedding at Johor. Tired, and feeling sick and disgusted after reading this just while ago.

‘PM Abdullah Badawi today said the BERSIH rally was an attempt to “trap” the Yang DiPertuan Agong and to drag royalty into politics.

He also made an oblique reminder to the Agong. Quote Star Online:

“I believe the King is mature, and the royalty will not be trapped into their (the opposition’s) politics,” he said after opening the 22nd Parti Bersatu Sabah (PBS) congress here on Sunday.’

What say you? I think he’s a bit over in his statement there… And this comment by a reader in a blog caught my attention.

“The rakyat know all this and yet are willing to go ahead – he must ask himself why. After all, he said he is for all of them.

They have no choice. They’re tired of all the sandiwaras, medicine-man doublespeaks, shenanigans, deflections, and one-bald-reason followed by another.

He should ask himself and his ilk one basic question – if he is so equally keen that the election process be fair and square, he should make sure that all avenues be laid open for the rakyat, no matter who they are, big or small, to make representation in whichever they think is right, to whomsoever they think can do something to improve matters.

Headline: Road closures, checks cause massive jams in Klang Valley

Several roads in the city centre were temporarily closed, resulting in massive traffic jams in the Klang Valley yesterday.

Inspector-General of Police Tan Sri Musa Hassan said the police were forced to use teargas and water cannons because the marchers refused to disperse when instructed to do so at 2.30pm. He put their number at 4,000.

A crowd of about 4,000 gathered for an illegal march close to Dataran Merdeka yesterday, causing massive traffic jams across the city.

All they farking reported was about traffic jam????!!!! Hey!!? Traffic jam? The traffic jam caused by the police erecting unnecessary roadblocks, road closures no? If only you allow the rally to go on peacefully (luckily they still managed to do that, contrary to what our PM hope, riots and disturbance to happen as what he predicted if the gathering continue) and work with the organisers to divert the traffic properly, prepare the necessary alternative routes and signs to motorists to avoid traffic congestion. Well, if you can send 4000 policemen to the gathering I am sure you can put them to better use.

And only 4000 people participated in the gathering? Bollocks! Unless I worshipped The Star, NST, Berita Harian, Utusan Malaysia, Harian Metro and other crap local dailies I will believe that. Seeing with my own eyes, and reading CNN, AFP, International Herald Tribune most of them reported minimum more than 40, 000 people attended the gathering.

Who you want to bluff heh? I present to you an interesting post on this number game by a blogger in his blog under the ‘Zero Deception’ I can only tell you, if our local newspaper reported the number as 10000, divide it by 10, actually is only 1000 or 10% percent lah.. like the report in The Star about expected 200, 000 people will attend our PM open house at PWTC back then. Read the post and analysis on that figure here in this post ‘Is it 200,000 or 20,000‘. So do you still blatantly believe the figure quoted by our ‘independent’ press?? Hahahaha!

Illegal gathering heh? What about the gathering by the SIL and his kuncu kuncu mat rempit in front of American Embassy to hand over a memorandum not so long ago?? That’s not illegal gathering lah right?? Farking bias lah you man.. Imaybe only obtained A2 for my SPM History paper, but I remember that our independence achieved by series of demonstration and rallies, no??

Read the history books again people.. Gathering and rallies is not something new, and it is not wrong if it is for something good. (Well in Malaysia, currently that will be anything that is perceived as sucking up the master balls, then it is sure good lah.. if you try to bark at the master then it is sure illegal, not good, malicious, inciting disharmony those shits lah.. Understand?)

This is history, something that must be remembered. On Nov. 10 more than 40,000 (some reported more than 50,000) people gathered for the BERSIH rally. If this is still considered as ‘minority’, ‘unrelevant’ voice then what is relevant? Since when we have a demonstration at this scale? During the Reformasi period?

This is the biggest public gathering in the country so far. Needless to say, that figure would have been much higher had the police not prevented and the people from attending the rally. What more with cars were checked for BERSIH materials and t-shirts, buses with passengers wearing BERSIH t-shirts were stopped, LRTs were not allowed to stop at the stations nearby to the gathering places.

So now you know, people are frustrated, people have grievances. They couldn’t bring it through the ‘proper’ channels so they take it to the streets, bracing the rains and FRUs, police, water cannons or maybe risk their lives for something they believe. Why do you think they did that when they could sleep at home, having great sex, watching porn, sleeping or doing whatever nice shits? It is because they care, you idiot!

Media Statement by BERSIH on Batu Burok Incident

The forum was organised by The Coalition for Clean and Fair Elections (BERSIH), and BERSIH has posted a media statement on the incident here. Hmm, I think I should post it in this post. Check out the bold portions guys. Have a read at Jeff Ooi’s post here. Notice how unified our mainstream media when reporting the incident. All singing the same tune, even appeared to use same source of photos, when you check out this photo!! Interesting? Boring…….. but of course, their reports should be the ‘official’ and ‘approved’ version to be published :D You should know better, right?

Media Statement: Incident in Batu Burok, KT

1. On 8th September 2007, the Coalition for Free and Fair Election or BERSIH that comprises various political parties and NGO’s planned to hold a peaceful rally in the form of road show to convey their demands for a free and fair election in Batu Buruk, Kuala Terengganu.

2. In compliance with the standard requirement, organizer of the event applied for a police permit, which was however rejected by the local police despite appeals made.

3. In preparation of the event, the organizer erected a stage for the rally but at 5pm on the said day, the police trespassed into the said area and dismantled the stage without prior permission from the property’s owner.

4. The police also conducted several road blocks to prevent members of the public from approaching the said site.

5. At approximately 9.40pm BERSIH leaders and representatives including, Dato’ Mustafa Ali (PAS State Commissioner) were refused entry to the site. Also present were Dr Syed azman Syed Ahmad Nawawi (BERSIH representative), Haji Muhammad Sabu (PAS representative), Tan Sri Khalid Ibrahim (PKR representative), YB Leong Ngah Ngah (DAP representative) and Haji Azmi Hamid (TERAS representative).

6. Negotiations were held between the representatives and the police, however the police insisted that the program be called off.

7. Tension erupted between the police and members of the public that have gathered for the event. The FRU arbitrarily discharged their water canon and fired tear gas towards members of the public, and this went on till late night.

8. An under cover police personnel later was found to have fired several shots towards members of the public who were assembling peacefully. One of the shots hit a member of the public, Suwandi Abdul Ghani, 37 which penetrated his lungs, while another, Muhamad Azman Aziz 21,was hit in the neck. Suwandi has been transferred to HUSM Kubang Kerian (from KT Hospital) for further treatment in a critical condition.

9. Dozens of members of the public were injured, 4 of them in serious condition.

10. 23 members of the public were detained by the police including three reporters. Two of them have since been remanded.

11. In the frenzy quite expectedly public property were damaged. And it subsided only after the police left at approximately 1.30am.

We therefore find:-

1. This unfortunate event occurred when the police denied the organizer permit for this peaceful rally despite an early application and appeal submitted.

2. That after having abided the decision made by the police to call off the event yet the police continued to apply provocation.

3. The main purpose of the event organized by BERSIH was to disseminate understanding amongst the rakyat of their democratic rights in demanding for free and fair elections. BERSIH among other demands, advocate the use of indelible ink, a complete revision of the electoral roll, the abolishment of postal votes and ensuring a fair media access.

4. Unfortunately, the police were used to block members of the public from exercising their rights in a democratic state, when they instead should focus to reduce the escalating crime rate in the country which is more of a menace to the rakyat as a whole.

5. We therefore find that it is most unfortunate that live bullets were used to disperse a peaceful rally. The usage of live bullets in addressing an issue such as this is most regrettable.

6. We therefore find that the police have failed to tackle this issue based on their own standard and procedures. There was no announcement whatsoever made for the crowd to disperse peacefully.

We hereby demand:-

1. That the Minister of Internal Security who is also the Prime Minister and the Inspector General of Police   explains the usage of live bullets in dispersing a peaceful event such as this.

2. All peaceful rallies conducted by any legitimate body should be accorded full assistance by the police without any need for a police permit.

3. The police should never be manipulated by the ruling Umno/BN for their cheap political interest.

4. The Terengganu Menteri Besar, Dato’ Seri Idris Jusoh as the Chairman of the State Security Committee should bear full responsibility in this unfortunate event.

We representatives of BERSIH hereby reiterate our full commitment in demanding for a democratic free and fair election in our beloved country.
